Liability Waiver and IndemnityIN CONSIDERATION of permitting me to enter the venue I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH Rendez-vous on July 26, 2024. including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.I certify I am physically fit, have sufficiently prepared or trained for participation in these activities, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in these activities. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activities in which I may participate, and that it will govern my actions and responsibilities at said activities.I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the NEGLIGENCE OR FAULT of the entities and/or persons released, for my death, disability, personal injury, property damage, property theft, exposure to any virus, including all variants of the COVID-19 virus, or actions of any kind which may hereafter occur to me including my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: Balaibalan LLC and/or their directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers, and Reza Mostofi, individually.I SHALL HOLD HARMLESS AND INDEMNIFY the persons and entities mentioned in this paragraph (Reza Mostofi and Balaibalan LLC, its agents, directors, officers and employees) from and against all losses, claims, damages, costs or expenses (including reasonable attorneys' fees, or similar costs) in connection with any action or claim brought or made (or threatened to be brought or made), for, or on account of any injuries or damages, received or sustained by myself arising during the course of activities associated with this event, or resulting from my mere presence at this event, including any and all claims arising from the negligence of all parties mentioned herein.This Accident Waiver, Non Disclosure Agreement and Release of Liability Agreement shall be construed broadly to provide a release and waiver to the maximum extent permissible under the laws of the state of Maryland. Any action to enforce the terms of this agreement shall be brought in a court of competent jurisdiction in Montgomery County, Maryland.
